Writs, Complaints and Summonses are formal legal documents that may require personal service or another specified method of service. It is important that the documents are served correctly and within any applicable deadline so the recipient is properly notified of the proceedings, hearing or action they are required to take.
Our experienced Process Servers regularly serve Writs, Complaints and Summonses on behalf of Plaintiffs, receiving instruction from lawyers, solicitors or directly from businesses and private clients. We review the service instructions, arrange attendance as quickly as possible and serve the documents in accordance with the applicable requirements and your instructions.
Our fixed fee includes up to three service attempts at a single address. Where further attendances are necessary, attempts can be made on different days and at different times to improve the likelihood of completing service.
Once service has been completed, we provide court-compliant Proof of Service confirming when, where and how the documents were served. Depending on the documents and the requirements of the proceedings, this may be provided as a Certificate of Service, Statement of Service or Affidavit of Service.
How Do You Serve a Writ, Complaint or Summons?
The correct method of serving a Writ, Complaint or Summons depends on the type of document, the court that issued it and the relevant procedural rules or directions. Some documents must be handed personally to the named recipient, while others may permit service by an alternative method such as by serving it at the property, or sometimes by leaving with another adult residing at the same address.
Our Process Server will follow the instructions provided and make an initial attendance as quickly as possible. Where personal service is required, the server will identify the intended recipient before handing over or clearly explaining the nature of the documents.
If the recipient is unavailable during the first visit, we can make further attempts on different days and at different times. Up to three attempts at one address are included within our fixed fee.
After successful service, we prepare the appropriate Proof of Service for use in the proceedings. If service cannot be completed, we can provide a Statement of Attempted Service detailing the attendances made and any relevant enquiries or information obtained. Notarised affidavits can be sworn when required.
