Do I need a Process Server to serve court documents?

Not always. Some documents can be served by post or other methods, whilst others require personal service by a Process Server. If you are unsure of the requirements in your case, contact us and we will be happy to discuss the options available. We do not provide legal advice but can explain the process of serving documents and then benefits of serving by Process Server rather than relying to postal service.

Do I need to provide the respondent's date of birth?

No. However, any additional information you can provide may assist our Process Server. Useful information can include a date of birth, telephone number, vehicle details, photograph, place of work or details of the respondent's routine.

What happens if service cannot be completed?

Accepted Answer

If we are unable to effect service, we will provide details of the attendances made and the information obtained. Depending on the circumstances, further enquiries, additional visits or an application for substituted service could be considered. We suggest you seek legal advice when usnure on the best course of action.

Can you serve documents on a company?

Accepted Answer

Yes. Our Process Servers regularly serve documents on limited companies, partnerships and other organisations. Service can often be effected at a registered office, trading address or upon a suitable representative, depending on the circumstances.

Can you provide an Affidavit of Service?

Accepted Answer

es. Where required, we can provide an Affidavit of Service sworn before a Solicitor, Commissioner for Oaths or Notary Public. Additional fees may apply.

Can you serve papers under Hague Convention Article 10b

Accepted Answer

Yes. We can assist with the service of foreign legal documents in England and Wales pursuant to Article 10(b) of the Hague Service Convention. Instructions must be received through a Solicitor in England and Wales, who acts as the competent person for the purposes of arranging service. Whilst the preferred method of service is often through the Central Authority, this can be a lengthy process. Service via Article 10(b) can provide overseas lawyers and legal professionals with a faster alternative where appropriate.
