It is important that service is completed compliantly and as quickly as possible, allowing sufficient time before any hearing date and ensuring the recipient is made aware of the Order and what they are required to do.

How Do You Serve an N39 or N79A Order?
An N39 Order to Attend Court for Questioning or an N79A Suspended Committal Order will usually need to be served personally on the named person. This means handing the documents directly to the Judgment Debtor or Officer of Company, or leaving in close proximity if they refuse to accept the Order and clearly identifying the nature of the documents being served.
Our Process Server will attend the supplied address as quickly as possible. If the recipient is unavailable during the first visit, we can make further attempts on different days and at different times. Up to three attempts at a single address are included within our fixed fee.
After successful service, we prepare an EX550 Affidavit of Service recording the circumstances of service. If the recipient cannot be served after the agreed attempts, we can instead provide evidence detailing the attendances made and the enquiries conducted. If we are unable to serve the Order to attend Court, we can assist you by providing a Statement of Attempted Service. You can use our evidence with an Application for Substituted Service. If granted, the Order can then be serve as directed by the Court.
