What to Expect From Compliant UK Process Servers
Today, we’re taking a closer look at what goes into professional process serving, what we need from you and what happens once your documents are ready for service.
Whether you are a solicitor working to a court deadline, an overseas lawyer arranging service in the UK or a private individual instructing a Process Server for the first time, a few clear details at the outset can help us get things moving.
More than delivering an envelope
Serving legal documents involves more than attending an address and handing over papers. We need to consider who must be served, the method required, any deadlines and the evidence you will need afterwards.
At PB Process Servers UK Ltd, we serve court orders, claim forms, statutory demands, injunctions, family court documents, divorce papers, possession proceedings and other legal notices.
Before arranging attendance, we review your instructions and the documents supplied. If there is a hearing date, a service deadline or a particular requirement in an order, please draw it to our attention when you send the papers.
We arrange attendance through our nationwide network, giving you one point of contact when documents need serving away from your own area. That might mean a London solicitor instructing us in Leeds, an overseas attorney requiring service in Manchester or a private client needing assistance elsewhere in the UK.
What happens if nobody answers?
An unanswered door does not necessarily mean someone is avoiding service. The recipient may be working, away from home or simply unable to answer. There may also be practical difficulties, such as locked gates, communal entrances or restricted workplace access.
Our fixed fee normally includes up to three attendances at a single address, with visits at varied times and on different days where appropriate. This gives us further opportunities to meet the recipient when an initial visit is unsuccessful.
Useful information can make those visits more effective. If you know the person works shifts, usually returns home in the evening or can be found at a workplace, tell us when instructing us.
Where difficulties arise, we record what happened and keep you informed as appropriate. If the available information suggests the recipient has moved or another approach is needed, we can discuss the options before additional work is arranged.
We cannot guarantee that a recipient will be present at a particular visit. We can provide properly planned attendance and a clear account of the outcome.
What do we need from you?
You do not need to prepare a lengthy background account. The most useful starting point is a complete set of documents and clear instructions.
Please provide:
The full name of the person or organisation to be served.
The full service address, including the postcode.
The final documents, with all relevant exhibits and attachments.
The required method of service and any specific court directions.
The service deadline, hearing date and level of urgency.
Any relevant identification details or practical information you lawfully hold.
Your contact details and the proof of service required.
A recent photograph, a description or information about working hours can help us identify the recipient and plan attendance. Entry codes, details of a flat’s location or information about access restrictions are also useful.
For a company or other organisation, please give us the correct legal entity name. Include any relevant contact name, job title or department, together with clear instructions about the address for service.
If you have a prescribed proof of service form or particular wording required by an overseas court, send that with the instruction.
Standard, priority and urgent attendance
Some instructions allow time for planned visits. Others need attention the following working day or sooner.
We offer standard and priority fixed-fee service options. Urgent and same-day attendance can also be arranged, subject to availability, location and the time we receive your instruction.
Tell us the actual deadline when you enquire. This helps us assess what can be arranged and recommend a suitable service level.
For urgent matters, sending the complete papers early and providing a direct contact number can make a considerable difference. Missing documents or an uncertain address can delay attendance even when a Process Server is available.
We confirm the fee and scope of the work before proceeding. Our usual fixed fee covers up to three attendances at one address for one case. Attendance at another address, separate cases or additional enquiries may involve further charges, which we will explain.
Clear proof of what happened
The record of attendance is an important part of the service.
Following successful service, we prepare the appropriate proof of service for the matter. Depending on your requirements, this may be a certificate, statement or affidavit recording the date, time, place and method of service, together with relevant identification details.
Where service is unsuccessful, a factual record of the attempts can help you decide what to do next. A Statement of Attempted Service may also be required to support an application for an alternative method of service.
Our evidence reflects what we saw, heard and did. If someone at the address gives us information, we distinguish what they told us from what we were able to establish ourselves.
When an address needs checking
Sometimes the immediate question is whether the recipient still has a connection to the address supplied.
An agreed enquiry agent visit may help establish whether a property appears occupied, whether a business is operating there or whether information available during the visit suggests the named person remains connected to it.
These visits are available to solicitors, businesses and private individuals, subject to the purpose and scope of the enquiry.
Address tracing is a separate service, which we accept only on instructions from solicitors and for a legitimate, lawful purpose. If you are unsure which service you need, explain what information you already hold and what you are trying to establish.
Ready to arrange service?
Send us the documents, the recipient’s address and any deadline. Include any practical information that may help with attendance, and let us know what proof of service you require.
We will review the instruction, confirm availability and provide a quote or fee estimate for the work.
At PB Process Servers UK Ltd, we help solicitors, overseas lawyers, businesses and private individuals arrange professional service throughout nearly all of the UK.
