When you need to serve an N39 Order to attend Court, it’s important to follow the correct legal process. At PB Process Servers UK Ltd, we specialise in helping solicitors, creditors, and individuals ensure that court orders are served properly, on time, and with full compliance.
What Is an N39 Order to Attend Court?
An N39 Order to Attend Court for Questioning is issued when a creditor requires a debtor to disclose their financial circumstances. The debtor must attend court and answer questions about their income, assets, and debts.
Failure to comply is serious – ignoring an N39 Order or N79a Suspended Committal Order could result in committal proceedings and even imprisonment. That’s why making sure the order is personally served is so important.
To serve a court order such as an N39, the Civil Procedure Rules require personal service. This means the process server must hand the document directly to the debtor. Unless you have permission from the Court, the order cannot be left at the property, or handed to anyone else.
The process usually includes:
Confirming the debtor’s correct address
Attending in person to hand over the order
Making repeat visits if necessary
Providing a legally valid Affidavit of Service (EX550) for the court to confirm the date of personal service, whether travel expenses were claimed and the amount due under the Judgment debt.
If an N39 Order is not served correctly, the court cannot move forward with enforcement.
Can you guarantee service of the Order?
No, it's impossible for us to guarantee papers will be served. A subject may have moved or be evasive. If the subject is evasive then we will normally prepare an affidavit or statement of attempted service that can support an application for substituted service. If you the court grant an order for substituted service then this will usually mean the Order can be served by letterbox, email or by WhatsApp or by any other means as the Court directs.
Be aware, any Process Server that says they guarantee service, is not telling you the truth! It simply is not possible to guarantee personal service.
