How to Serve a Claim Form for Possession of Property

If you need to regain possession of a property, serving the Claim Form correctly is one of the most important stages of the possession process. Whether you're dealing with rent arrears, anti-social behaviour, a tenant who refuses to leave, or unlawful occupiers, mistakes at this stage can lead to delays, additional costs and even the hearing having to be re-listed.

At PB Process Servers UK, we regularly serve possession proceedings on behalf of solicitors, landlords, property management companies and businesses throughout the UK. This guide explains the basic process and why many people choose to instruct a professional Process Server.

Please note: This guide is intended as general information only and does not constitute legal advice. If you are unsure how to proceed, you should seek advice from a solicitor specialising in landlord and tenant law.

Step 1 – Obtain the Correct Claim Form

In most residential possession proceedings, the claim is started using Form N5 (Claim Form for Possession of Property), together with any supporting documents required by the court.

The appropriate forms can be obtained from the court or downloaded from the GOV.UK website.

Step 2 – Complete the Claim

Complete the claim carefully, ensuring all information is accurate. This will normally include:

  • The claimant's details.

  • The defendant's details.

  • The address of the property.

  • The legal grounds for seeking possession.

  • Any supporting information or documentation.

Errors or missing information can result in delays, so many landlords choose to have the paperwork prepared by a solicitor.

Step 3 – Issue the Claim

Once completed, the claim is submitted to the appropriate County Court together with the applicable court fee.

After the court issues the claim, it will specify the hearing date and the deadline by which the documents must be served on the defendant.

Step 4 – Serve the Claim Form

This is where a professional Process Server can make a real difference.

Possession proceedings must be served in accordance with the relevant court rules and within the required timescales. Failure to serve the documents correctly may delay the hearing or require the claim to be re-issued.

By instructing PB Process Servers UK, you benefit from:

  • Fast nationwide service.

  • Experienced Process Servers familiar with possession proceedings.

  • Priority and same-day attendance where required.

  • Regular progress updates.

  • Independent proof that service has been completed.

We also have experience serving documents where defendants may be avoiding service or where attendance at different times of the day is necessary.

Step 5 – File Proof of Service

Once the documents have been served, evidence of service should be filed with the court.

This is usually completed by filing Form N215 (Certificate of Service) or, where appropriate, a Witness Statement confirming when, where and how service took place.

Accurate proof of service is essential, as the court will often require confirmation that the defendant has been properly served before the hearing proceeds.

Why Use a Process Server?

Although some possession documents can be served by other methods, many landlords and solicitors prefer to instruct a professional Process Server for peace of mind.

Using an experienced Process Server provides:

  • Prompt attendance at the property.

  • Independent evidence of service.

  • Reduced risk of service being challenged.

  • Assistance where occupants are evasive or difficult to contact.

  • Confidence that the documents have been served correctly and on time.
