Who Can Issue a Statutory Demand?

In many cases, anyone who is owed money can issue a Statutory Demand. You do not necessarily need to instruct a solicitor or lawyer, although obtaining independent legal advice is always recommended if you are unsure whether a Statutory Demand is appropriate for your circumstances or how to complete it correctly.

When used correctly, a Statutory Demand can be an effective debt recovery tool. After the demand has been personally served, the debtor normally has 21 days to pay the debt, reach an agreement, or apply to have the demand set aside (where applicable). If they fail to respond, you may be able to begin insolvency proceedings, such as bankruptcy against an individual or winding-up proceedings against a company, subject to the relevant legal requirements.

How to Get a Statutory Demand Served


The first step is to complete the correct Statutory Demand form. The form you need depends on:


  • Whether the debtor is an individual or a company.

  • Whether the debt is payable immediately or at a future date.

  • Whether the debt arises from a court judgment or another type of liability.


Once completed and signed, simply send the Statutory Demand to your chosen Process Server together with your instructions. This can usually be done by email for the quickest turnaround, although you may also send hard copies by post. If posting, it is helpful to provide two signed copies of the demand.


Your Process Server will then arrange personal attendance at the service address and make the necessary attempts to complete service in accordance with the Insolvency Rules. Once service has been successfully completed, you will receive a Certificate of Service or other appropriate proof of service for your records or any future court proceedings.
